8. Links & Third-Party Services

The Service may contain links or integrations with third-party services. We are not responsible for the content, policies, or practices of third parties. Your interactions with third-party services are solely between you and them.

9. User-Generated Content

If you submit comments, reviews, or other content (“User Content”):

  • You grant Kenyon a worldwide, perpetual, irrevocable, royalty-free license to use, display, reproduce, and adapt your User Content for business and marketing purposes.
  • You represent you have the necessary rights to the User Content and that it does not infringe others’ rights.
  • You may not submit content that is unlawful, abusive, defamatory, infringing, or otherwise objectionable.
  • We reserve the right to remove User Content but are not obligated to monitor it.

10. Copyright Infringement (DMCA)

11. Data Privacy & Security

  • We maintain industry-standard safeguards to protect your information, but no system is completely secure.

12. Orders & Transactions

  • By confirming a purchase, you agree to pay all applicable charges and taxes.
  • We reserve the right to cancel or refuse orders due to pricing errors, suspected fraud, or policy violations.
  • Risk of loss passes to you upon our delivery to the carrier.
  • Refunds and returns are subject to our Return Policy.
  • Payment processing may be handled by third-party providers (e.g., Stripe, PayPal). We do not store your full payment details.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KENYON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

16. Indemnification

You agree to indemnify and hold harmless Kenyon from all claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or your breach of these Terms.

17. Dispute Resolution & Arbitration

  • These Terms are governed by the laws of Connecticut, USA.
  • Any disputes will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), unless you opt out within 30 days of first accepting these Terms by notifying us in writing.
  • Arbitration will take place in New Haven County, Connecticut.
  • You waive the right to participate in class actions. Claims may only be brought individually.
  • Small claims court remains available as an alternative for qualifying disputes.

18. Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control, including natural disasters, supply chain disruptions, pandemics, labor disputes, or government actions.

19. Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining terms will remain in effect. Our failure to enforce any right is not a waiver of future enforcement.

20. Electronic Communications

By using the Service, you consent to receive electronic communications from us, which may include notices, agreements, and updates.
